Terms of Service

By accessing or using the JobWriter platform, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

1.  License to Use

JobWriter grants you a limited, non-exclusive, non-transferable license to access and use the platform solely for your organization’s internal recruitment purposes. This license does not include the right to resell, redistribute, or sublicense access to the platform.

2.  Your Content

All job postings, descriptions, and other content you create using JobWriter are yours. You retain full ownership of everything you produce on the platform and may use it freely for any lawful recruitment or hiring purpose.

3.  Prohibited Uses

You may not:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, methodology, or underlying logic of the JobWriter platform or any component thereof
  • Copy, replicate, or reproduce the platform’s behavioral framework, attribute library, scoring logic, or any proprietary methodology for use outside the platform or in any competing product or service
  • Use the platform to develop, train, or improve any competing software, tool, or AI model
  • Share login credentials or allow unauthorized parties to access your account
  • Use the platform for any unlawful purpose or in violation of applicable employment laws

4.  Intellectual Property

JobWriter and its underlying technology — including but not limited to its behavioral science framework, attribute library, Inner Hero methodology, posting logic, and analytics engine — are the exclusive intellectual property of JobWriter. Nothing in these Terms transfers any ownership of that intellectual property to you.

5.  Confidentiality

You agree to treat the platform’s methodology, logic, and any non-public features as confidential. You will not disclose these to third parties without JobWriter’s prior written consent.

6.  Account Responsibility

You are responsible for all activity that occurs under your account. You agree to notify JobWriter immediately of any unauthorized access or breach of security.

7.  Disclaimer of Warranties

JobWriter is provided “as is” without warranties of any kind, express or implied. JobWriter does not warrant that the platform will be uninterrupted, error-free, or that it will produce any specific hiring outcome.

8.  Limitation of Liability

To the maximum extent permitted by law, JobWriter’s liability to you for any claim arising out of your use of the platform is limited to the fees you paid in the three months preceding the claim. JobWriter is not liable for indirect, incidental, consequential, or punitive damages of any kind.

9.  Termination

JobWriter may suspend or terminate your access at any time for violation of these Terms. Upon termination, your license to use the platform ends immediately. Your ownership of content you have already created is not affected.

10.  Changes to These Terms

JobWriter may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms.

11.  Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the JobWriter platform shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, before a single arbitrator in New York County, New York. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to protect its intellectual property rights or confidential information without waiving the right to arbitrate all other claims. JobWriter expressly reserves this right in cases of unauthorized use, reverse engineering, or misappropriation of its proprietary methodology or technology.

You waive any right to bring claims as a plaintiff or class member in any class action, consolidated action, or representative proceeding.

12.  Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles.
